Patna High Court

Mahendra SinghversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court held that bail could not be granted to the petitioner at the present stage of the proceedings.

Summary

Mahendra Singh, a 78‑year‑old accused, sought regular bail in a case involving charges of murder, attempt to murder, causing hurt, and conspiracy under IPC sections 302, 342, 323, 120(B) and 34. His bail application had been rejected twice earlier. The State opposed bail, highlighting his prior conviction for murder and fresh allegations concerning the informant’s mother, an eye‑witness. The petitioner’s counsel argued that his advanced age warranted bail. The Court examined the seriousness of the offences, the existence of a prior conviction, and the stage of the trial, and concluded that bail could not be granted at this stage. Consequently, the bail application was dismissed.

                                 4. Learned APP for the State, on the other hand,

opposes the prayer for bail and submits that, though the

petitioner has been in custody since 10.07.2023 and is aged

about 78 years, he has one criminal antecedent under Section

and the submissions made above, this Court is not inclined to

grant bail to the petitioner at this stage. Accordingly, the bail

application of the petitioner is hereby rejected.

                                                                     (Dr. Anshuman, J.)
