Holding

The Court ordered the release of the petitioner on regular bail with a bond and sureties.

Summary

The petitioner, Dharmpal Kumar, was arrested in connection with the alleged possession of a country‑made pistol and three empty cartridges, charged under sections 25(1‑b)a and 26 of the Arms Act. He contended that the seized items were not in his possession and that the police failed to comply with Section 105 of the BNSS while preparing the seizure list. The petitioner had been in judicial custody since 28‑10‑2025 and had no prior criminal record. The State opposed the bail application, arguing the seriousness of the arms offences. After hearing both sides, the Court found the procedural lapse and the petitioner’s clean antecedents sufficient to grant regular bail. Accordingly, the petitioner was released on a bail bond of Rs.10,000 with two sureties of equal amount.

Issues considered

  • Whether bail should be granted in a case involving offences under sections 25(1‑b)a and 26 of the Arms Act
  • Whether the failure to comply with Section 105 of the BNSS in preparing the seizure list warrants bail
  • Whether the duration of judicial custody and lack of prior criminal antecedents justify release on bail
