Patna High Court

Dharamveer Kumar Sahu @ Dharamveer Kumar SahversusThe State of Bihar

Decided

Holding

The Court granted bail to the petitioner, holding that the evidence on record did not justify continued detention.

Summary

The petitioner, Dharamveer Kumar Sahu, was arrested in connection with a robbery and armed assault alleged under Section 309(6) of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. The prosecution's case relied on a withdrawn amount of Rs. 3,50,000 and a confession by co-accused Suman Saurav, who implicated the petitioner. The petitioner argued he was innocent, had no criminal record, and that no material evidence or recovery was made against him, nor was a thorough investigation (T.I.P.) conducted. The State opposed bail, citing the seriousness of the offences. After hearing both sides, the Court found the lack of substantive evidence and the reliance on a co-accused's confession insufficient to deny bail, and ordered the petitioner to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail can be granted to the petitioner under Section 309(6) of the B.N.S., 2023 and Section 27 of the Arms Act given the circumstances of the case.
  • Whether the confessional statement of a co‑accused alone is sufficient ground to deny bail.
