Bail was not granted; the application was dismissed.
Summary
Karu Singh, the petitioner, filed his fourth bail application in a Sessions trial (No.203 of 2021) concerning offences under Sections 302, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act. The case, arising from PS Bypass Case No.220 of 2020, was reported to be on the verge of conclusion. The petitioner’s counsel argued for bail, while the State’s Additional Public Prosecutor opposed it. Justice Sandeep Kumar considered the seriousness of the charges—murder, attempt to murder, common intention, and illegal possession of arms—and the fact that the trial was nearing its end. Concluding that granting bail at this stage would be inappropriate given the gravity of the offences, the court dismissed the bail application.
Issues considered
- Whether bail should be granted to the petitioner in a case involving murder, attempt to murder, common intention, and illegal possession of arms when the trial is near conclusion.
