Bail was granted to Dharmendra Kumar subject to surrender within four weeks and a bail bond of Rs. 10,000 with two sureties.
Summary
The petitioners, Dharmendra Kumar and Lalveer Yadav, sought bail in connection with a criminal case (PS No. 72 of 2024) involving offences under the Bihar Narcotic Substances (BNS) Act and the Arms Act, including allegations of assault and a firearm injury. The petitioners' counsel withdrew the bail application for Lalveer Yadav, leading the court to dismiss that part of the application and direct him to surrender within two weeks and apply for regular bail. For Dharmendra Kumar, the court noted only a general allegation and allowed the bail application, imposing conditions of surrender within four weeks, a bail bond of Rs. 10,000, and two sureties of the same amount. The court clarified that its order is limited to bail and does not prejudice the merits of the trial. The bail was granted subject to the stipulated conditions.
Issues considered
- Whether bail should be granted to Dharmendra Kumar in light of the pending charges under the BNS Act and Arms Act.
- Whether the conditions of surrender and bail bond are appropriate.
