Patna High Court

Amarjeet DomversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted subject to strict conditions.

Summary

Amarjeet Dom was arrested on 31‑10‑2025 in connection with a case alleging that he assaulted an informant with a knife, causing only simple injuries. He was charged under multiple sections of the Bharatiya Nyay Sanhita, 2023. The petitioner claimed innocence, arguing that the injury was minor and that the allegations were fabricated, while the prosecution highlighted three prior criminal antecedents and opposed bail. The court examined the nature of the injury, the seriousness of the offences, and the petitioner’s antecedents, and concluded that bail could be granted. Accordingly, the court ordered his release on a Rs 10,000 bail bond with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • Whether bail should be granted despite the petitioner being charged with multiple offences under the Bharatiya Nyay Sanhita, 2023.
  • Whether the simple nature of the injury and the petitioner’s claim of innocence outweigh the prosecution’s claim of prior criminal antecedents.
  • Whether the conditions imposed are sufficient to ensure the petitioner’s compliance with the trial process.
