Patna High Court

Sultan Rain @ Sultan RainaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioners subject to the stipulated conditions.

Summary

The petitioners, Sultan Rain and his wife Bahisa Khatoon, sought anticipatory bail fearing arrest in a case registered under several IPC offences, including assault with a deadly weapon. The prosecution alleged that on 14 June 2024 the petitioners assaulted an informant with an axe after a dispute over the informant's daughter‑in‑law. The petitioners contended they were innocent, highlighted the six‑day delay in filing the FIR, and asserted no charge against the wife, emphasizing their clean antecedents. The State opposed the bail application. The Court, considering the delay, lack of clear evidence against the wife, and the petitioners' claims, granted anticipatory bail subject to a bail bond of Rs 10,000 each with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 despite the FIR alleging offences under the IPC.
  • Whether the delay in lodging the FIR and the absence of specific allegations against the wife justify granting anticipatory bail.
