Patna High Court

Md. Chand @ Chand BabuversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, finding insufficient grounds to deny it given the lack of conscious possession and procedural irregularities.

Summary

The petitioner, Md. Chand Babu, was arrested on 5 January 2026 in connection with a case involving the seizure of 104.370 litres of illicit liquor from a Scorpio vehicle. He contended that he was neither the owner nor the driver of the vehicle and that no liquor was found in his conscious possession, arguing that the investigation violated Sections 103 and 105 of the BNSS, 2023. The prosecution opposed bail, citing the recovery of the liquor and the petitioner’s prior criminal antecedent, though noting he was already on bail in another matter. The High Court examined the lack of direct possession and procedural lapses, and consequently ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions regarding cooperation, non‑tampering with evidence, and verification of his criminal record. The bail order was conditioned on compliance with the stipulated terms and allowed for cancellation if conditions were breached.

Issues considered

  • What is the applicability of bail provisions when the accused is not in conscious possession of the seized illicit liquor?
  • Whether non‑compliance with Sections 103/105 of the BNSS, 2023, warrants denial of bail?
  • Impact of the petitioner’s prior criminal antecedent on the bail decision.
