The Court granted anticipatory bail to the petitioners, subject to conditions, finding no sufficient ground to deny bail under Section 482(2) of BNSS 2023.
Summary
The petitioners, Runki Devi and Pappu Yadav, applied for anticipatory bail in a complaint case alleging their involvement in the murder of the informant’s sister, which was allegedly motivated by dowry demands. The prosecution alleged that the deceased’s husband, Abhishek Kumar, and co‑accused committed the murder after subjecting the victim to cruelty and harassment. The petitioners, who are the mother‑in‑law and father‑in‑law of the deceased, contended that they have no connection to the incident, possess a clean antecedent, and are being over‑implicated. The State opposed the grant of anticipatory bail. Considering the petitioners’ clean record and lack of direct involvement, the Court ordered anticipatory bail subject to surrender within eight weeks, a bail bond of Rs 10,000 with two sureties, and compliance with Section 482(2) of the BNSS 2023. The order effectively protects the petitioners from arrest pending further investigation.
Issues considered
- Whether anticipatory bail can be granted to the petitioners under Section 482(2) of BNSS 2023 despite the serious nature of the allegations.
- Whether the petitioners’ clean antecedent and lack of direct involvement justify the grant of anticipatory bail.
