Decided

BAIL GRANTED

Holding

Bail was granted to the petitioner subject to monetary surety and specific conditions.

Summary

Sudhir Kumar was arrested on 13 January 2026 in connection with a case involving alleged illegal withdrawal of Rs. 1,20,000 by cheque. The prosecution alleged that he, along with co‑accused Rahul Kumar, participated in the fraud and that the petitioner had obtained the informant's cheque book. The petitioner’s counsel argued that he had a clean antecedent and was falsely implicated, though the record shows a confession by the petitioner. The Additional Public Prosecutor opposed bail, citing the seriousness of the offences under Sections 318(2), 319(2) and 303(2) of the Bihar Negotiable Instruments Act, 2023. The court, after considering the circumstances, granted bail on a cash bond of Rs. 10,000 with two sureties and imposed conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • Whether bail should be granted to the petitioner charged under Sections 318(2), 319(2) and 303(2) of the Bihar Negotiable Instruments Act, 2023 despite his confession and the seriousness of the alleged offence.
