BAIL REJECTED

Holding

The anticipatory bail application is rejected; no relief can be granted to the petitioner.

Summary

The petitioner, Raman Kumar, sought anticipatory bail fearing arrest in a case registered under Sections 363, 366A, 504, 506 and 34 of the Indian Penal Code. The prosecution alleged that the petitioner, along with others, abducted the informant's daughter and later forced her to marry him, as recorded in the FIR. The girl later gave a statement under Section 183 of the BNSS corroborating the prosecution's version. The petitioner contested the allegations, but the Assistant Public Prosecutor highlighted the recorded statement supporting the charge. After considering the material, the Court found no basis to grant anticipatory bail and rejected the petition. The order effectively disposes of the bail application.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner in view of the FIR and the victim's statement under Section 183 BNSS.
  • Whether the statements recorded under Section 183 BNSS substantiate the prosecution's case against the petitioner.
