Md. ShamshadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to a bond and conditions under Section 482(2) of the BNSS, 2023.

Summary

The petitioner, Md. Shamshad, sought anticipatory bail fearing arrest in a case (Wajitpur PS Case No.86 of 2025) alleging his involvement in assault with a sharp weapon and other offences under the Bihar Negotiable Substances Act, 2023. The prosecution alleged that the petitioner and another accused attacked an informant, causing injuries, and also committed offences against the informant’s son. The petitioner contended he was innocent, asserting that he was himself injured and his hand broken on the same date, rendering him incapable of committing the alleged acts, and highlighted a separate case filed by his wife. The State opposed bail, citing a witness statement that the petitioner had already sustained injury. The Court, after considering the facts and the provisions of the BNSS, 2023, granted anticipatory bail subject to a Rs.30,000 bond and conditions under Section 482(2) of the Act.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bihar Negotiable Substances Act, 2023.
  • Whether the petitioner’s alleged injury and prior criminal antecedent preclude the grant of bail.
  • Whether the prosecution’s evidence is sufficient to deny anticipatory bail.
