Sheikh Shamshad @ MalahaversusThe State of Bihar

Decided

Holding

In the absence of any direct evidence against the petitioner and considering his clean record, the court held that he is entitled to regular bail.

Summary

The petitioner, Sheikh Shamshad, was arrested in connection with a murder case registered under sections 103(1) and 3(5) of the BNS. The prosecution’s case is based solely on the confessional statement of a co‑accused, Salim Akhtar, with no eyewitness testimony or other direct evidence linking the petitioner to the crime. The petitioner asserted his innocence, highlighted his lack of criminal antecedents, and noted that he has been in judicial custody since 17‑06‑2025. The State opposed the bail application, but the court examined the paucity of material evidence and the petitioner’s prolonged detention. Considering these factors, the court ordered the petitioner’s release on regular bail upon furnishing a bond of Rs 10,000 with two sureties. The order was directed to be complied with by the District and Additional Sessions Judge, Bettiah, West Champaran.
