Holding
Pre‑arrest bail was denied because the offence is grave and the victim’s statements under sections 180 and 183 BNS support the prosecution.
Summary
Petitioner Bishal Ram was implicated in a case registered under sections 329(4) and 74 of the BNS for criminal trespass with the intention of outraging the modesty of an informant. The victim’s statement recorded under section 180 of the BNS, and a further statement under section 183 of the BNS, both corroborated the prosecution’s case. The petitioner applied for pre‑arrest bail, arguing apprehension of arrest. The Court examined the seriousness of the alleged offence, the victim’s corroborative statements, and the gravity of the charges. Considering these factors, the Court rejected the petition for pre‑arrest bail. The order was delivered by Justice Prabhat Kumar Singh.
