Indal MandalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond and specified conditions.

Summary

Indal Mandal was arrested on 6 February 2026 in connection with the seizure of 110 litres of illicit liquor alleged to violate Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act, 2018. The petitioner contended that the liquor was recovered from an open bush and not from his possession, and that the investigating authorities failed to comply with Sections 103 and 105 of the BNSS. The prosecution opposed bail, citing three prior criminal cases of a similar nature, although the petitioner was already on bail for those matters. The Court examined the factual matrix, the alleged procedural lapses, and the petitioner’s antecedents, and decided to grant bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents. The order directed the Special Judge Excise‑II, Khagaria to accept the bail without delay for verification purposes.

Issues considered

  • Whether bail should be granted to the accused under the Bihar Prohibition and Excise Act, 2018 in view of alleged non‑possession of the seized liquor.
  • Whether non‑compliance of Sections 103 and 105 of the BNSS warrants denial of bail.
  • Whether the petitioner’s prior criminal antecedents affect the grant of bail.
