Patna High Court

Sujeet Kumar Singh @ Sujeet KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court denied anticipatory bail to the petitioner.

Summary

The petitioner, Sujeet Kumar Singh, sought anticipatory bail after being implicated in a case registered under Sections 126(2), 115(2), 118(1), 110, 303(2), 352, 351(2) and 3(5) of the BNS for allegedly assaulting a woman with an iron rod, causing head injury and unconsciousness, and for assaulting her daughter with a lathi and stealing a gold locket. He contended that he was falsely implicated due to a land dispute and that the allegations were vague and unsupported by any witness. The State opposed the bail application, emphasizing the seriousness of the specific assault allegations. The court observed that the petitioner's conduct, including failure to disclose any prior criminal antecedent, warranted a cautious approach. Accordingly, the court declined to grant anticipatory bail and dismissed the application.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the specific assault allegations under the BNS.
  • Whether the petitioner's failure to disclose prior criminal antecedents justifies denial of anticipatory bail.

                                3. The prosecution case, as per the FIR, is that on

12.11.2025 at about 8:00 AM, while the informant was working

at her door, a dispute arose when her goat went near the

Singh assaulted the informant’s daughter with a lathi, causing

                     injury.

                                   4. The learned counsel for the petitioner submits that

the petitioner is innocent and has falsely been implicated. There

is land dispute between the parties. The allegation against the

petitioner is general and omnibus. No witness has supported the

                                   6. Considering the fact that there is specific allegation

of assault against the petitioner Sujeet Kumar Singh with iron

rod on the head of the informant, causing head injury and also

taking notice of the conduct of the petitioner of having not

disclosing the criminal antecedent before the learned court

below, I am not inclined to grant anticipatory bail to the

                     petitioner.

                                   7. Accordingly, the application stands rejected.
