Nirmal Ram @ Nirmal KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs.10,000, two sureties, and surrender within eight weeks under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Nirmal Ram, was charged under several IPC sections including assault, robbery, attempt to murder, and criminal intimidation. He alleged that the injury caused to the informant was simple and highlighted his clean antecedent. Fearing arrest, he applied for bail, which the State opposed. The Court considered the nature of the injury, the petitioner’s clean record, and the seriousness of the charges. It ordered that bail be granted upon furnishing a bond of Rs.10,000 with two sureties and required surrender within eight weeks, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether bail should be granted to the petitioner despite the gravity of the offences alleged.
  • Whether the conditions imposed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 are appropriate.
