Patna High Court

Nandan KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court held that anticipatory bail could not be granted as the injury was grievous and the offences alleged justified denial.

Summary

The petitioner, Nandan Kumar, applied for anticipatory bail in connection with FIR No. 168 of 2025 alleging offences under Sections 115(2), 126(2), 110, 351(2), 352 and 3(5) of the B.N.S. The prosecution alleged that the accused, armed, assaulted the informant causing a grievous injury to the nose. The petitioner argued that there is a case and counter‑case and that he has no prior criminal record. The opposing counsel produced the injury report showing the wound to be grievous, which was also reflected in the Sessions Judge's order. Considering the seriousness of the injury and the nature of the alleged offences, the Court declined to extend anticipatory bail and rejected the bail application.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the allegation of a grievous injury.
  • Whether the nature of the offences under the B.N.S. warrants denial of anticipatory bail.
