The Court granted bail to the petitioner.

Summary

The petitioner, Aman Kumar, applied for bail in a case registered as Rail Mansi G.R. P.S. Case No.31 of 2025, alleging an offence under Section 303(2) of the B.N.S. The prosecution alleged that the petitioner stole the informant’s bike. The petitioner claimed innocence, stating the FIR was lodged against unknown persons and that he had already been granted bail in a related Begusarai Town P.S. case where he gave a confessional statement. He also highlighted that no incriminating material was recovered from him and that he had been in judicial custody since 1 November 2025. The State opposed the bail, citing the petitioner’s prior criminal antecedents. After hearing both sides, the Court decided to enlarge the petitioner on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the Railway Judicial Magistrate’s satisfaction.

Issues considered

  • Whether bail should be granted to the petitioner in a case under Section 303(2) of the B.N.S. considering his prior criminal antecedents and a confessional statement in a related case.
