Anticipatory bail was granted to the petitioner subject to conditions under Section 482(2) of the BNSS.
Summary
The petitioner, Ranjit Singh, sought anticipatory bail fearing arrest in a murder case (Pakaridayal P.S. Case No. 35 of 2025) involving offences under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The prosecution alleged that Singh, along with others, killed the deceased, who was related to the informant Kajal Kumari. The court examined the facts, noting the petitioner’s relationship with the deceased and the circumstances of the investigation. It concluded that the anticipatory bail application was maintainable and granted bail on the condition of a Rs.10,000 bond with two sureties, to be executed within four weeks, subject to Section 482(2) of the BNSS. The order was made clear to be prima facie and not to affect the merits of the trial.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the Bharatiya Nyaya Sanhita, 2023
- Whether the nature of the alleged offences (murder and illegal possession of arms) justifies denial of anticipatory bail
