The court granted regular bail to the petitioner.

Summary

The petitioner, Sonu Sah, was charged under multiple sections of the Indian Penal Code for alleged assault with a farsa causing head injuries to Binod Kumar Sah. The prosecution alleged that the petitioner inflicted the injuries, while the defence argued that the medical report indicated injuries caused by a hard blunt object, not a farsa, and that the dispute stemmed from a land conflict. The petitioner had been in judicial custody since 11 October 2025 and the State highlighted three prior criminal cases against him. The defence counsel submitted that the injury report did not corroborate the prosecution’s version and that the petitioner was innocent. After considering the medical evidence, the nature of the injuries, and the petitioner’s custody duration, the court granted regular bail on a bond of Rs.10,000 with two sureties.

2 23-03-2026 Heard learned counsel for the petitioner and learned

                   APP for the State.

                                 2. The petitioner has prayed for regular bail in a case

registered for the offence punishable under sections 147, 149,

                   341, 323, 324, 325, 307, 354, 379, 504 and 506 of Indian Penal

                   Code.

                                 3. The case of the prosecution is that the petitioner has

assaulted with farsa on the head of one Binod due to which he

                   received head injuries.

                                 4. Learned counsel for the petitioner submits that the

petitioner is innocent and has committed no offence. Learned

counsel for the petitioner has submitted that there is land dispute

between the parties and there is also a counter version of this

case. From perusal of the injury report of Binod Kumar Sah

which is annexed at P/5, it transpires that the injured has

received four injuries:- (I) Lacerated wound over scalp (ii)

lacerated wound over left forearm (iii) swelling over left

forearm (iv) Abrasion over right side of forehead. Learned

counsel has submitted that the doctor conducting the medical

examination of injured Binod has opined that all the injuries are

simple in nature caused by hard and blunt substance. He has

also submitted that the injury report does not correlate with the

allegation. There is allegation that the petitioner has assaulted

with farsa whereas the injury report goes to show that the

assault was made by hard and blunt substance. Moreover, the

petitioner is languishing in judicial custody since 11.10.2025.

                       5. Learned APP appearing for the State has

vehemently opposed the prayer of regular bail and has

submitted that petitioner is having criminal antecedent of three

          cases.

                       6. Having heard learned counsel for the parties and

considering the facts and circumstances of the case, this court is

inclined to enlarge the petitioner on bail. The above named

petitioner is directed to be released on bail in connection with
