The court granted regular bail to the petitioner.

Summary

Chandan Kumar was arrested in connection with the alleged possession of 2.75 litres of country-made liquor, seized from a polythene bag, under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed he was falsely implicated, argued that the seizure was not made in his conscious possession, that the only witnesses were police officers, and that the mandatory provisions of Section 105 of the BNSS were not complied with. He had been in judicial custody since 12 February 2026. The State opposed bail, citing three prior criminal convictions. The High Court, after considering the facts and procedural issues, granted regular bail on a bond of Rs.10,000 with two sureties, subject to the petitioner’s cooperation in the trial and abstaining from similar offences.

Issues considered
