Pramod YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a cash bond, two sureties, a charitable donation, and regular police‑station attendance.

Summary

The petitioner, Pramod Yadav, was arrested in connection with the seizure of eight litres of country-made liquor under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022. He had been in custody since 26‑11‑2025 and faced sixteen other similar criminal cases. The petitioner claimed innocence and offered to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the bail application. The court, after considering the facts and submissions, ordered the petitioner’s release on bail upon furnishing a cash bond of Rs. 10,000 with two sureties of the same amount, depositing Rs. 25,000 with the Ramakrishna Mission Ashram, and attending Gopalganj Police Station every Sunday, failing which bail would be cancelled.

Issues considered

  • Whether bail should be granted to a person accused under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.
  • Whether the existence of multiple prior similar cases precludes the grant of bail.
