Decided

BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond of Rs.10,000, two sureties and attendance conditions.

Summary

Indal Kumar was arrested in connection with a case registered under Sections 25(1‑B)(a), 26 and 35 of the Arms Act for possession of a loaded pistol. He had been in custody since 11‑Nov‑2025 and claimed to have a clean antecedent. The petitioner applied for bail, arguing that the period of detention was long and that he had no prior criminal record. The High Court, after considering the facts, allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to appear at the police station on the first and third Sundays of each month. The court also ordered verification of the petitioner’s antecedent before accepting the bail and clarified that the order was limited to the bail application and did not prejudice the trial.

Issues considered

  • Whether the petitioner is entitled to bail in a case under Sections 25(1‑B)(a), 26 and 35 of the Arms Act
