DISMISSED

Holding

The application for regular bail is dismissed.

Summary

The petitioner, Rajkran Kumar, was arrested following a police raid on 22 November 2025 during which two mobile phones and Rs.2000 were seized from him. He is charged under multiple sections of the Bihar Penal Code (sections 316(2), 318(4), 319(2), 336(3), 338, 340(2), 3(5) and 61(2)) and sections 66(c) and 66(d) of the Information Technology Act for alleged cyber‑fraud. The petitioner filed an application for regular bail, claiming innocence and false implication, while the State opposed the bail on the ground of the seriousness of the alleged cyber‑offence. The Court examined the nature of the offences and the recovery of an iPhone from the petitioner’s possession. Concluding that the allegations of cyber fraud warranted denial of bail, the Court dismissed the bail application.
