Holding

The court allowed the petitioner's application for regular bail.

Summary

The petitioner, Santu Yadav, was arrested in connection with a case registered under Sections 25(1‑b)(a), 26(i) and 35 of the Arms Act after a country‑made pistol and four cartridges were recovered from him. He pleaded innocence, claimed he had been falsely implicated, and noted that he had been in custody since 2 August 2025 despite having nine prior criminal antecedents. He applied for regular bail, undertaking to cooperate with the trial. The Additional Public Prosecutor opposed the bail, but the court, after considering the length of custody, allowed the bail application. The petitioner was released on a bail bond of Rs.10,000 with two sureties and was directed to appear at the police station every Sunday, with non‑appearance leading to cancellation of bail.
