Decided
Disposal
DISMISSED

Holding

The Court dismissed the bail application, holding that bail could not be granted given the gravity of the offences.

Summary

The petitioner, Gunja Kinner, applied for regular bail in a case registered under Sections 126(2), 115(2), 103(1) and 3(5) of the B.N.S., alleging that she was falsely implicated in the murder of her partner. The prosecution alleged that she was the informant, filed a false FIR, and subsequently killed the deceased. The petitioner’s counsel argued that she has a clean antecedent, has been in custody since 06‑01‑2026, and is willing to cooperate with the trial. The State’s Additional Public Prosecutor opposed bail, emphasizing the seriousness of the alleged murder. Considering the gravity of the offences, the Court declined to grant bail and dismissed the application.
