Bunty Pandey @ Banti PandeyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the petitioner's regular bail with conditions.

Summary

The petitioner, Bunty Pandey, was arrested in connection with a dacoity case (Kuchaikote PS Case No. 87/2023) and charged under Sections 399, 402, 412 and 34 of the IPC and Sections 25(1‑b)(a), 26 and 35 of the Arms Act. The prosecution alleged that he, along with others, planned a dacoity and a country‑made pistol with three cartridges was recovered. The petitioner claimed innocence, asserted that he had been falsely implicated, and noted that he had six prior criminal antecedents and had been in custody since 21‑02‑2025. He applied for regular bail, undertaking to cooperate with the trial. The Additional Public Prosecutor opposed the bail, but the court, considering the length of custody, allowed the bail with a bond of Rs. 10,000 and two sureties, subject to conditions that the bailors be blood relatives and that the petitioner appear at the police station every Sunday. The bail order was pronounced by Justice Sandeep Kumar.
