BAIL GRANTED

Holding

The application for bail is allowed.

Summary

Basudev Kewat was arrested on 4 February 2026 in connection with an excise case (No. 79c2 of 2026) alleging possession of 5 litres of illegal liquor and 41 kg of Jawa Mahua solution, offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed innocence, stating he was a labourer returning home after work and was detained only on suspicion due to prior antecedents. The State opposed bail, arguing the seriousness of the alleged contravention. The Court examined the custody period, the nature of the alleged offence, and the petitioner's personal circumstances. It concluded that the reasons for continued detention were not compelling enough to deny regular bail. Accordingly, the Court ordered the petitioner’s release on bail of Rs. 10,000 with two sureties and imposed attendance conditions at the police station.

Issues considered

  • Whether regular bail should be granted to the accused in an excise case under Section 30(a) of the Bihar Prohibition and Excise Act considering the facts and custody period.
