The Court grants anticipatory bail to the petitioner, subject to conditions, as the seizure is questionable and the petitioner has only one prior criminal antecedent.
Summary
The petitioner, Raja Kumar, was implicated in a case alleging possession of a pickup truck loaded with illicit foreign liquor concealed under paddy husk, under the Bihar Prohibition and Excise (Amendment) Act. The police seized 889.2 litres of liquor but did not recover anything from the petitioner’s conscious physical possession, and the seizure memo lacked signatures of two independent witnesses, raising doubts about its validity. The petitioner, who has only one prior criminal antecedent, applied for anticipatory bail, claiming innocence. The State opposed the bail, but the Court noted the procedural flaws in the seizure and the petitioner’s limited criminal history. Relying on Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Court granted anticipatory bail with a bond of Rs.10,000 and two sureties, subject to cooperation with the investigation and verification of the antecedent.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 given the circumstances of the alleged offence.
- Whether the seizure of the liquor is valid in view of the lack of signatures of independent witnesses on the search and seizure memo.
