Patna High Court

Vidya Sagar Choudhari @ Vidyasagar ChoudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to all four petitioners, subject to a bond and conditions ensuring their presence at trial.

Summary

The petitioners, four residents of Kajipur village, were charged under multiple sections of the Bharatiya Nyaya Sanhita, 2023 for allegedly pushing a dancer who fell and injuring her, and for allegedly snatching Rs.12,000 from an informant. Their earlier bail application was rejected on 11 August 2025, but they filed a fresh application seeking regular bail, contending that the injury was accidental and that they have cooperated with the trial. The State opposed the bail, emphasizing the seriousness of the offences. The court noted that more than eight months had elapsed since the earlier rejection and the petitioners had been in custody since 14 March 2025. Considering the elapsed time, the nature of the allegations, and the petitioners' willingness to cooperate, the court granted bail to all four petitioners on a bond of Rs.10,000 with two sureties each, subject to conditions of physical presence at trial and possible cancellation for non‑cooperation. The order directs the bail bond to be satisfied to the Principal District and Sessions Judge, Buxar.

Issues considered

  • Whether the petitioners are entitled to bail despite being charged under serious offences under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the earlier rejection of bail can be revisited after a substantial lapse of time.
  • Whether the alleged accidental injury and lack of intent justify the grant of bail.
  • What conditions may be imposed on bail to ensure the petitioners' cooperation with the trial.
