Vikash YadavversusThe State of Bihar

Decided

DISMISSED

Holding

The court held that bail could not be granted and dismissed the regular bail application.

Summary

The petitioner, Vikash Yadav, was arrested in connection with a loot at Sanjiv Kumar's shop, alleged to have been committed with illegal firearms. He is charged under Sections 309(4) and 317(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(1‑b)a, 26 and 35 of the Arms Act. The petitioner, who has five prior criminal convictions, filed a second application for regular bail after an earlier bail plea was rejected. Counsel for the petitioner argued for bail, emphasizing his submissions, while the State opposed on grounds of the seriousness of the offences and the petitioner’s antecedents. The court, after considering the gravity of the allegations and the petitioner’s criminal history, declined to grant bail and dismissed the application.

Issues considered

  • Whether regular bail should be granted to the petitioner given the seriousness of the offences under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail
