Patna High Court

Vikram Kumar SharmaversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The Court ordered that bail be granted to both petitioners on a bond of Rs.10,000 with two sureties, subject to cancellation if a prior excise offence is later discovered.

Summary

Vikram Kumar Sharma and Hamid Rab were arrested in connection with an Excise case (No. 324 of 2025) for allegedly possessing 43.2 litres of IMFL, alleged offences under sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act, 2016. The petitioners claimed they were falsely implicated, asserted that no incriminating article was recovered from them, and highlighted their clean record. The chargesheet had been filed and they had been in custody since 9 December 2025. After hearing both sides, the Court considered the lack of antecedent, the filing of the chargesheet, and the circumstances of the FIR, and ordered that regular bail be granted on a bond of Rs.10,000 with two sureties, subject to cancellation if any prior excise offence is later discovered. The order was pronounced by Justice Partha Sarthy of the Patna High Court.

Issues considered

  • Whether regular bail should be granted to the accused in an excise case under sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act, 2016, considering they have been in custody since 9 December 2025, have no criminal antecedent, and a chargesheet has been filed.
