Decided

REJECTED

Holding

The court denied bail to the petitioner, holding that the seriousness of the offences and the supporting evidence warranted continued custody.

Summary

The petitioner, Gautam Kumar, was arrested on 1 April 2025 in connection with a POCSO case alleging the rape of a 12‑year‑old girl, the informant's daughter. He is charged under Sections 75 and 76 of the Bihar Narcotic Substances Act, 2023 and Sections 8 and 12 of the POCSO Act. The prosecution presented the victim's statement recorded under Section 164 of the Cr.P.C., corroborating witnesses and medical evidence, and opposed bail. The petitioner claimed the FIR was fabricated and asserted his innocence. After considering the seriousness of the offences and the evidentiary material, the court refused the bail application, concluding that the petitioner should remain in custody.

Issues considered

  • Whether bail should be granted to an accused in a POCSO case involving alleged rape of a minor under Sections 75, 76 of the BNS Act, 2023 and Sections 8, 12 of the POCSO Act.
