The court granted bail to the petitioners, directing them to furnish a bond of Rs.10,000 each with two sureties.

Summary

The petitioners applied for bail in a case registered as Kochas P.S. Case No. 37 of 2026, alleging offences under Sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Act for allegedly possessing illicit foreign liquor. The prosecution alleged that two vehicles were seized, and a Scorpio contained 406.05 litres of illegal liquor. The petitioners contended they were innocent, not present in the seized vehicle, had no criminal antecedent, and had been in judicial custody since 13 February 2026. The State opposed bail. After hearing both sides, the High Court considered the facts, the petitioners' lack of prior record, and their claim of non‑involvement, and ordered that bail be granted on a bond of Rs.10,000 each with two sureties, subject to the satisfaction of the Exclusive Special Excise Court No. II, Sasaram.

Issues considered

  • Whether the petitioners are entitled to bail pending trial for offences under Sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Act.
  • Whether the circumstances of the case, including the petitioners' claim of innocence, lack of antecedent, and custodial status, justify the grant of bail.

Subjects

  • bail
  • Bihar Prohibition and Excise Act
  • criminal procedure
  • illicit liquor
  • judicial custody
