Holding

The application is disposed of as there is no reason to keep the case pending.

Summary

Ganesh Ram filed an application in the Patna High Court seeking further directions in a criminal case (PS. Case No.174/2004). The court noted that an earlier order dated 21‑08‑2023 had already directed the Superintendent of Police to have the investigating officer examined within a month and that the doctor had been examined. No counsel appeared for one of the respondents despite proper service, and the petitioner's counsel could not contact his client for instructions. Given these circumstances and the fulfillment of prior directions, the court found no justification to keep the matter pending. Consequently, the application was disposed of.

Issues considered

  • What, if any, further direction or relief should be granted to the petitioner in the pending application?
  • Whether the case should continue to be kept pending in view of the compliance with earlier directions?

Subjects

  • criminal procedure
  • application disposal
  • investigation
