Patna High Court

Mukesh Yadav @ Mukesh Kumar @ Mukesh Kumar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a bail bond and sureties.

Summary

The petitioner, Mukesh Yadav, applied for bail in a case originally registered under Sections 364, 120‑B and 34 of the IPC, with Sections 302 and 201 later added. The prosecution alleged that the petitioner, along with co‑accused, murdered the informant’s son due to a personal dispute. The petitioner argued that the FIR was based only on suspicion, the informant was not an eye‑witness, and key witnesses had turned hostile, leaving no material linking him to the crime. The State opposed bail, citing the seriousness of the offences. The court, noting the lack of substantive evidence and the fact that similarly situated co‑accused had already been released on bail, ordered the petitioner’s release on bail upon furnishing a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences (IPC Sections 364, 120‑B, 34, 302, 201).
  • Whether the prosecution has produced sufficient material evidence to justify continued detention.
