BAIL GRANTED

Holding

The court allowed the petition for regular bail, granting release on bond with conditions.

Summary

The petitioner, Manish (also known as Rajveer Singh, Kundan Kumar, Rajiv Kumar), was arrested in connection with PS Kadamkaun Case No. 753/2025 for an alleged offence under Section 64 of the B.N.S., accused of having a sexual relationship with the informant. The petitioner claimed innocence, asserting that the relationship had ended and the complaint was false, and highlighted his clean antecedents and cooperation with the trial. The informant’s counsel indicated that the dispute between the parties had been settled. The State opposed the regular bail, but the court considered the circumstances, including the petitioner’s willingness to cooperate and lack of prior record. Consequently, the court granted regular bail on a bond of Rs. 10,000 with two sureties, subject to the condition of appearing in court as required.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 64 of the B.N.S. in light of the allegations and his custody since 26-10-2025.
