Holding

The court ordered that the petitioner be released on regular bail upon furnishing the prescribed bond and sureties.

Summary

The petitioner, Ranvir Kumar, was arrested in connection with an excise case where 18 litres of IMFL were recovered from his motorcycle. He alleged that he was falsely implicated and that no incriminating article was found in his possession. He had been in custody since 12 January 2026 and applied for regular bail under sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016. The State opposed the bail, but the court considered the allegations in the FIR and the length of custody. The court directed that the petitioner be released on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to the satisfaction of the Exclusive Special Excise Judge.

Issues considered

  • Whether regular bail should be granted to the petitioner under sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016 considering the facts of the case and the period of custody.
