Patna High Court

Shivam KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Shivam Kumar was arrested on 22 November 2025 in connection with a case of alleged abduction under Sections 137(2), 140(4) and 3(5) of the BNS, 2023. The prosecution alleges that the petitioner, along with another accused, forcibly abducted a woman who later identified him as the perpetrator. The petitioner contended that the FIR is false, claiming a consensual secret meeting with the woman and asserting a clean criminal record. He applied for bail, arguing that the allegations are fabricated and that he has been in custody for over four months. The High Court, after hearing both sides, granted bail on a Rs.10,000 bond with two sureties, imposing conditions of cooperation with the trial, appearance in court, and non‑tampering with evidence, while also directing verification of his antecedents.

Issues considered

  • Whether bail should be granted to the petitioner accused of offences under Sections 137(2), 140(4) and 3(5) of the BNS, 2023.
  • Whether the petitioner poses a risk of tampering with evidence or witnesses.
  • Whether the petitioner’s claim of a false FIR and clean antecedent warrants bail.
