Patna High Court

Prince Kumar @ Prince RajversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court denied anticipatory bail to the petitioners.

Summary

The petitioners, Prince Kumar and Nitish Kumar, feared arrest in a criminal case registered under Sections 137(2) and 96 of the B.N.S., alleging kidnapping of a girl for marriage. An informant alleged that the petitioners, along with others, abducted his daughter, and the victim’s statement under Section 183 of the B.N.S.S. corroborated the prosecution’s case. The petitioners filed an application for anticipatory bail to avoid detention pending investigation. The learned counsel for the State opposed the bail, emphasizing the seriousness of the kidnapping allegation. After hearing both sides, the Court rejected the petition for anticipatory bail, concluding that the circumstances did not warrant such relief.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners in a kidnapping case under Sections 137(2) and 96 of the B.N.S.
  • Whether the facts disclosed justify denial of anticipatory bail
