REJECTED

Holding

The court refused to grant bail to the petitioner.

Summary

The petitioner, Jaikant Ravidas, was arrested on 19 August 2025 in connection with a dowry‑related death of his wife, who was found dead on 17 August 2025. The FIR, registered under Sections 80 and 3(5) of the BNS, alleged that the petitioner, along with other family members, participated in the victim's murder by manual strangulation. The petitioner pleaded that he has a clean record, the allegations are fabricated, and no specific act is ascribed to him, citing that co‑accused in‑laws had already been granted bail. The State opposed bail, relying on a post‑mortem report that detailed multiple antemortem injuries consistent with homicidal strangulation. The court examined the seriousness of the injuries, the likelihood of the petitioner’s involvement, and the risk to public safety, and concluded that bail could not be granted. Consequently, the petition for bail was dismissed.

                                3. The prosecution case, in brief, is that the daughter

of the informant who was married to the petitioner, was

continuously subjected to abuse, assault, and dowry demand of

₹1 lakh by her husband and in-laws. The matter was earlier

matrimonial home, and the information was conveyed to the

informant by a neighbour on 18.08.2025. He suspected that the

accused persons, including the petitioner, had killed his daughter

by strangulation, leading to registration of the F.I.R.

                       4. Learned counsel for the petitioner submits that the

petitioner has clean antecedent, the allegation as alleged in the

FIR is false and fabricated and the petitioner has not committed

any offence as alleged in the FIR. The petitioner has been made

accused in the present case merely on the ground that the

petitioner is the husband of the deceased. He further submits

that from bare perusal of the FIR, it appears that the petitioner is

named in FIR but there is no specific allegation of any assault or

overt act attributed against the petitioner rather there is general

and omnibus allegation against all the accused persons including

the petitioner. Further submits that for the same set of allegation

the co-accused persons namely, Yasoda Devi and Kopal Das,

who happens to be the in-laws of the petitioner have been

granted bail by this Court vide order dated 28.01.2026 passed

in Cr. Misc. No. 4078 of 2026.
