Patna High Court

Lalan PaswanversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court refused to grant anticipatory bail to the petitioner, finding the offence serious and the petitioner’s prior criminal antecedent sufficient to deny bail.

Summary

The petitioner, Lalan Paswan, feared arrest in a case registered under Section 303(2) of the Bihar Narcotic (or related) Statute, 2023, alleging that he assisted a co-accused in selling a stolen tractor belonging to an informant. The FIR also disclosed that the petitioner has a prior criminal record for a similar offence. He applied for anticipatory bail, arguing that the nature of the accusation and his antecedents did not justify detention. The learned counsel for the State opposed the bail, emphasizing the seriousness of the charge and the petitioner’s past conduct. The Court, after hearing both sides, held that the combination of the serious offence and the petitioner’s criminal antecedent warranted denial of anticipatory bail. Consequently, the petition for anticipatory bail was rejected.

Issues considered

  • What is the appropriate exercise of discretion by the court in granting or refusing anticipatory bail under Section 438 of the Criminal Procedure Code in view of the seriousness of the offence under Section 303(2) of the B.N.S., 2023 and the petitioner’s prior criminal antecedent?
