Holding

Bail is granted to the petitioner with specified conditions.

Summary

The petitioner, Deepak Yadav, sought bail in a case (PS Case No.384 of 2025) for alleged contravention of Section 30(a) of the Bihar Prohibition of Excise Act after police seized 1,794.375 litres of foreign liquor from a saw‑mill premises. The prosecution’s case relied mainly on a confessional statement of co‑accused Dinesh Prasad Saxena, who alleged that the petitioner stored the liquor, while no liquor was found in the petitioner’s possession. The petitioner’s counsel argued that the confession of a co‑accused alone is insufficient evidence, that the petitioner had no possession of the liquor, and highlighted his prior criminal cases as a possible frame‑up. The State opposed bail, citing the seriousness of the offence. After hearing both sides, the court granted bail, imposing conditions of personal attendance at trial, weekly reporting to the police station, and a bail bond of Rs 10,000 with two sureties of equal amount.

Issues considered

  • Whether bail can be granted to the accused under Section 30(a) of the Bihar Prohibition of Excise Act when the only evidence is a co‑accused’s confessional statement.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
  • Whether the absence of direct possession of the seized liquor by the petitioner warrants bail.
