Holding

The Court granted bail to the petitioner.

Summary

Manish Ray was arrested in connection with a case registered under multiple sections of the Bihar Negotiable Statutes and Section 27 of the Arms Act for alleged indiscriminate firing, ransacking of household articles and damage to a vehicle. The petitioner claimed innocence, alleging political victimisation and asserted that no injury was caused, while noting that co‑accused had been granted bail in a similar case. The State opposed bail, highlighting the petitioner’s antecedent of twelve criminal cases. After hearing both sides, the Court considered the lack of specific injury, the petitioner’s prolonged custody since 6 January 2026, and the precedent of bail to co‑accused. The Court ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties, subject to conditions of cooperation and regular attendance.

Issues considered

  • Whether bail should be granted to the petitioner despite serious charges under the B.N.S. and Arms Act and his prior criminal record.
