The Court granted bail to the petitioner, directing a bond of Rs.10,000 with two sureties.

Summary

Shankar Kumar was arrested in connection with an excise case (Case No. 121 of 2026) for allegedly transporting 160 litres of country-made liquor, alleged offences under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act. The petitioner contended that he was merely a passenger, had no knowledge of the liquor, and that the police failed to comply with Section 105 of the B.N.S.S. He also highlighted his clean record and that he had been in judicial custody since 2 February 2026. The State opposed bail, arguing the seriousness of the offence. After hearing both sides, the Court found the petitioner's claim of innocence plausible and noted the procedural lapse, and therefore ordered bail on a bond of Rs.10,000 with two sureties. The bail order was directed to be satisfied before the Special Judge, Excise, Danapur.

Issues considered

  • Whether bail should be granted to the petitioner in an excise case involving alleged possession of 160 litres of illicit liquor.
  • Whether the petitioner’s claim of being a mere passenger and lack of knowledge negates the charge under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act.
  • Whether the failure of police to comply with Section 105 of the B.N.S.S. affects the bail decision.
