Patna High Court

Ravi KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond of Rs.10,000 and specified conditions.

Summary

Ravi Kumar was arrested on 19 November 2025 in connection with a case involving alleged armed robbery and offences under Sections 309(4) & 3(5) of the BNS and Section 27 of the Arms Act. The prosecution alleges that unknown persons, at gunpoint, threatened an informant, fired at him and stole his vehicle, which has not been recovered. The petitioner contends that he was falsely implicated, his name entered the FIR only after a co‑accused’s confessional statement, and he maintains his innocence. He also points out that a similarly situated co‑accused was previously granted bail. The State opposes bail, citing three other pending cases against the petitioner, though the petitioner claims he is already on bail in those matters. The High Court, after considering the submissions, granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding cooperation, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • Whether bail should be granted to the petitioner in a case involving offences under Sections 309(4) & 3(5) of the BNS and Section 27 of the Arms Act.
  • Whether the petitioner’s alleged prior criminal cases and the fact that a co‑accused has been granted bail affect the bail decision.

                                       ORAL ORDER

3 01-05-2026 Heard Mr. Ranjeet Kumar, learned counsel for

the petitioner and Mr. Anil Kumar, learned APP for the State.

                                2. The petitioner seeks bail, who is in custody since

19.11.2025 in connection with Panapur Kariyat P.S. Case No.

133 of 2025, F.I.R. dated 25.08.2025 registered for the offence

under Sections 309(4) & 3(5) of BNS and Section 27 of the

                   Arms Act.

                                3. The prosecution case, in brief, is that some

unknown persons on the gunpoint threatened the informant,

fired at him and took away his vehicle. Despite search, the

                   vehicle could not be recovered.

                                4. Learned counsel for the petitioner submits that

petitioner is innocent and he has falsely been implicated in the

present case. It has been further submitted that the name of the

petitioner has been transpired during the course of investigation

solely on the basis of the confessional statement of co-accused

person. It appears from the FIR that initially the petitioner was

not named in the FIR. Thereafter, the petitioner has confessed

his guilt in the present occurrence. The petitioner has been

remanded in the present case from Vaishali P.S. Case No. 644 of

2025 on 19.11.2025. He further submits that the similarly

situated co-accused person has been granted bail by this Court

vide order dated 17.03.2026 passed in Cr. Misc. No. 16746 of

2026. The police, after investigation, submitted the charge-sheet

against the petitioner. The petitioner is languishing in judicial

          custody since 19.11.2025.

                       5. Learned APP for the State, on the other hand, has

vehemently opposed the prayer for bail of the petitioner and

submits that petitioner carries three more cases other than the

present one but he fairly submits in paragraph 3 of the bail

petition that petitioner is on bail in the pending matters.

                       6. Considering the aforesaid facts, let the petitioner,

above named, be released on bail on furnishing bail bond of

Rs.10,000/- (Ten Thousand) with two sureties of the like amount

each to the satisfaction of learned Chief Judicial Magistrate,

Muzaffarpur in connection with Panapur Kariyat P.S. Case No.

133 of 2025, with the following conditions:-

                                    (I) Petitioner shall co-operate in the trial and shall be

properly represented on each and every date fixed by the Court

on his/her absence on two consecutive dates without sufficient

reason, his/her bail bond shall be cancelled by the Court below.

(II) If the petitioner tampers with the evidence or the

witnesses, in that case, the prosecution will be at liberty to move

                       for cancellation of bail.

(III) And, further condition that the court below shall

verify the criminal antecedent of the petitioner and in case at

any stage, it is found that the petitioner has concealed his

criminal antecedent, the court below shall take step for

cancellation of bail bond of the petitioner. However, the

acceptance of bail bonds in terms of the above-mentioned order

shall not be delayed for purpose of or in the name of

                       verification.
