Patna High Court

Niraj Kumar Choudhary @ Niraj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner, subject to a bail bond and sureties.

Summary

The petitioner, Niraj Kumar Choudhary, applied for regular bail in a case registered under Sections 8(c) and 21(b) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, alleging possession of 23.1 grams of smack. The prosecution intercepted an Alto car and recovered the narcotics from the petitioner and another accused. The petitioner claimed innocence, argued that the seized quantity was below the commercial threshold, and contended that the procedural safeguards of Section 50 NDPS were not observed. The State opposed the bail on the ground of the seriousness of the offence and the petitioner’s prior criminal antecedent. The Court, after considering the facts, the period of custody, and the amount involved, ordered that the petitioner be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties of equal amount, thereby allowing the application.

Issues considered

  • Whether regular bail can be granted to the accused under the NDPS Act for possession of a quantity below commercial threshold
  • Whether the procedural requirements of Section 50 of the NDPS Act were complied with
  • Impact of the petitioner’s prior criminal antecedent on the grant of bail
