Patna High Court

Santosh MahtoversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Santosh Mahto was arrested on 1 February 2026 in connection with a case under Section 30(a) of the Bihar Prohibition & Excise Act for alleged recovery of 2,000 litres of country‑made liquor. The petitioner claimed he had no conscious possession of the liquor, that the seizure was from a boat he did not own, and that he was falsely implicated. He also highlighted that a co‑accused, Kishan Kumar, had been granted bail in a similar case and that the prosecution had not complied with Section 103 of the Bihar Narcotic Substances Suppression Act, 2023. The State opposed bail, but the Court considered the lack of possession, the non‑compliance of Section 103, and the precedent of bail to the co‑accused. Consequently, the Court granted bail on a Rs.10,000 bond with two sureties and imposed conditions regarding cooperation, presence, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • Whether bail should be granted despite non‑compliance of Section 103 of the Bihar Narcotic Substances Suppression Act, 2023.
  • Whether the absence of conscious possession and the fact that the liquor was recovered from a boat not owned by the petitioner justify bail.
  • Whether the granting of bail to a similarly situated co‑accused (Kishan Kumar) influences the decision on bail for the petitioner.
