Dhandhan NatversusThe State of Bihar

The court granted bail to the petitioner.

Summary

The petitioner, Dhandhan Nat, was arrested in connection with a robbery (Section 395 IPC) where eight to ten persons allegedly looted Rs. 40,000 from a victim's residence. The petitioner claims innocence, arguing that the only incriminating evidence is the confessional statements of co‑accused Gorakh Nut and Firoj Nut, who named him, but no material was recovered from him and no Test Identification Parade was conducted. He points out that the co‑accused were previously granted bail in a similar case (Cr. Misc. No. 17162 of 2025) and that he has been in judicial custody since 8 January 2026. The State opposed bail, citing the petitioner's three prior criminal cases. After hearing both sides, the court found the lack of direct evidence and the precedent of bail for co‑accused sufficient to grant bail, ordering the petitioner to furnish a Rs. 10,000 bond with two sureties.

Issues considered

  • Whether bail should be granted to the accused in a robbery case under Section 395 IPC in view of confessional statements of co‑accused and absence of direct evidence.
  • Whether the petitioner's prior criminal antecedents preclude the grant of bail.
